Update: In-Custody Death Investigation

The Kalamazoo Department of Public Safety has completed its investigation of the May 6th, 2016 In-Custody Death involving Mr. James Dunigan. The investigation included a review of the completed autopsy report by the Kalamazoo County Office of the Medical Examiner, discussion with the Kalamazoo County Medical Control Authority (KCMCA) relative to their review process, interviews of all associated parties and review of applicable KDPS policies and procedures.

The Kalamazoo County Office of the Medical Examiner (KCOME) determined that Mr. Dunigan’s significant medical and personal history were the only factors involved in his death. Below is direct from the Postmortem Examination Report:

“Cause of Death: Hypertensive atherosclerotic cardiovascular disease, diabetes mellitus, chronic obstructive pulmonary disease, and end stage renal disease complicated by acute intoxication by the combined effects of hydrocodone, diphenhydramine, ephedrine and gabapentin”

“Other Conditions: Chronic cocaine use, fentanyl ingestion”

“Manner of Death: Accident”

Any further interpretation of the Postmortem Examination Report or the review process by the Kalamazoo County Medical Control Authority is under the purview of the KCOME or the KCMCA respectively.

The Office of Professional Standards investigation included a review of applicable KDPS policies and procedures, all associated video, interviews of Bronson Hospital Security and Staff, PSO Nugent, and PSO Shaffer. That review identified a policy violation relative to prisoner medical attention; specifically the officers should have recognized Mr. Dunigan’s condition and sought medical treatment. As a result the officers were given a one day suspension. I came to this conclusion after considering the totality of the circumstances.

At our request, the KCMCA will assist the KDPS with an after action review which will include an analysis of protocol, training and best practices.

On behalf of KDPS and the City of Kalamazoo we extend our continued condolences to the Dunigan family and I apologize for any failings on the part of KDPS.
